Judge Invalidates Trump Admin’s Detention Policy

A federal judge in the United States has invalidated a ruling by an administrative board that supported the Trump administration’s practice of detaining individuals arrested during its immigration enforcement without offering them the opportunity for bond hearings. Judge Sunshine Sykes in Riverside, California, stated that the administration had disregarded her previous order deeming the policy unlawful. The judge instructed the Department of Homeland Security to notify detainees of their eligibility for bond and grant them access to legal counsel within an hour. The decision comes amidst a divergence of opinions among U.S. courts on the issue of mandatory detention for immigrants. While some courts have upheld the administration’s actions, many others, including Judge Sykes, have ruled against the government’s interpretation of the law.

The ruling by Judge Sykes signifies that immigration judges can no longer use the board’s decision to deny bond hearings. Advocates for the plaintiffs hope that this ruling will put an end to mandatory detention and lead to a reinstatement of bond hearings for detained noncitizens. The Department of Homeland Security defended its actions, citing previous Supreme Court rulings in its favor. Meanwhile, the Department of Justice, responsible for overseeing the immigration appeals board, did not immediately respond to requests for comment.

With bond hearings restricted, thousands of immigrants have resorted to filing individual petitions in federal court seeking release. Despite some successful petitions, the administration has been found to be in violation of court orders to release individuals or provide alternative relief. Judge Sykes, appointed by former President Joe Biden, has repeatedly ruled against the mandatory detention policy, extending her decisions nationwide. In her recent ruling, she emphasized the importance of due process for immigrants, highlighting the impact on families, communities, and the nation as a whole.
