The Supreme Court of Canada has invalidated the outcome of a tightly contested riding from the previous spring’s election. This decision necessitates a new byelection for the Terrebonne constituency in the Montreal area. Initially declared for the Bloc Québécois, the riding was later awarded to the Liberals by a single vote following a judicial recount.
The legal action to annul the results and call for a fresh election was initiated by Nathalie Sinclair-Desgagné, the Bloc candidate. This move came after a voter named Emmanuelle Bossé had her mail-in ballot returned due to a misprint on the return envelope. Despite acknowledging the error, Elections Canada had already finalized the results.
Following the recount, Liberal Tatiana Auguste assumed office as the MP for Terrebonne and has been representing the riding since. The Superior Court initially dismissed Sinclair-Desgagné’s plea for a new election, citing a postal code error as a human mistake rather than an electoral irregularity. However, the Supreme Court overturned this decision after deliberations.
Sinclair-Desgagné hailed the court’s ruling as a triumph for democracy and criticized Elections Canada for not rectifying their mistake promptly. Elections Canada affirmed its readiness to conduct a byelection in Terrebonne in response to the recent decision.
This incident marks another setback for the Liberal Party’s seat count, as they were on the brink of securing a majority earlier this year. With two Conservative defections and recent resignations of former cabinet members, the Liberals now trail by four seats. Although Freeland and Blair’s seats are considered safe for the party, Terrebonne is expected to present a more challenging electoral battle.
Terrebonne, historically a Bloc stronghold, saw a reversal in results on election night, with Sinclair-Desgagné initially declared the winner by 44 votes. However, a close margin triggered a judicial recount that ultimately favored Auguste. Once the Speaker declares a vacancy in the House, a minimum 11-day waiting period is required before a byelection can be scheduled.
