The owner of Yorkdale Shopping Centre is currently in a legal battle to prevent the Fairweather brand from opening a store in the mall, citing concerns that it could harm the center’s upscale image.
Fairweather Ltd., a budget-friendly women’s fashion retailer, seeks to take over the former Hudson’s Bay space to introduce a revived version of the Quebec-based department store Les Ailes de la Mode under the name “Ailes,” as per court documents.
In a court filing dated January 9, lawyers representing Oxford Properties criticized Fairweather for its minimal investment in store aesthetics, alleging that its stores have a temporary and low-end appearance, describing the company as “not creditworthy.” Despite attempts by CBC Toronto to contact Fairweather, lawyers representing the subleasing party argued that Fairweather is creditworthy and that Ailes would offer higher-end clothing.
The court is now deliberating on the case, which could significantly impact the future of one of Canada’s largest and most renowned shopping centers.
Owned by business magnate Isaac Benitah, Fairweather is part of a family enterprise that also manages Wyrth, Bombay, Bowring, and International Clothiers. The Benitah family recently acquired the rights to Zellers, a discount retailer.
Oxford’s legal team, led by D.J. Miller, has raised concerns that having an “unsuitable” tenant like Fairweather could lead to substantial financial losses amounting to hundreds of millions of dollars.
Fairweather previously leased space at Yorkdale until 2020. However, Oxford argues that Fairweather lacks the necessary expertise to manage a 300,000 square foot retail space, as most of its other locations are significantly smaller.
Nadia Corrado, a vice-president at Oxford, emphasized in a November affidavit that allowing Fairweather to occupy the prime location at Yorkdale would be highly inappropriate and damaging, expressing concerns about the company’s long-term presence in the mall.
Background and Legal Proceedings
Prior to the current dispute, Hudson’s Bay leased the space at Yorkdale through a joint venture with RioCan Real Estate Investment Trust. Following Hudson’s Bay’s insolvency filing, FTI Consulting was appointed as the receiver of the joint venture and selected Fairweather as the new occupant, a decision supported by RioCan.
RioCan’s spokesperson, Stephanie Sallah, affirmed that Fairweather brings substantial retail experience and is a suitable replacement for Hudson’s Bay at Yorkdale.
FTI’s legal team, led by Orestes Pasparakis, argued that Ailes would cater to a higher price point than Fairweather’s other brands, emphasizing Fairweather’s creditworthiness and industry experience.
