“Canada’s Military Oversight Body Criticizes Handling of Officer’s Sexual Assault Case”

Canada’s military police oversight body released a critical report on Thursday regarding the investigation of a deceased air force officer facing sexual assault charges in early 2022. Major Cristian Hiestand, who tragically took his own life, expressed frustration to his family over not being heard before his passing. The Military Police Complaints Commission (MPCC) Chair, Tammy Tremblay, highlighted flaws in the investigation process, citing a lack of impartiality and thoroughness, rushing to judgment, and confirmation bias.

The report coincides with the ongoing debate surrounding the Liberal government’s legislation to reform the military’s handling of sexual misconduct cases. The proposed bill seeks to transfer the authority to investigate and prosecute such cases from the military to civilian law enforcement and judicial bodies.

The MPCC received multiple complaints regarding the military police’s conduct in the Hiestand case. The investigation revealed various shortcomings, including failures to properly document interviews, involvement of intoxicated supervisors, and inadequate handling of critical evidence. The MPCC issued recommendations to enhance investigative practices, but most were rejected by the Canadian Forces Provost Marshal, raising concerns about accountability.

Family spokesperson Rory Fowler expressed gratitude for the MPCC’s efforts but criticized the military’s reluctance to address the investigation’s deficiencies. The Hiestand family believes that the military police’s actions contributed to Cristian’s tragic death. Hiestand, a respected pilot and veteran, faced charges of sexual assault shortly before his passing, leading to his removal from duty and isolation from colleagues.

An internal inquiry by the Department of National Defence cleared the military police officers involved of any wrongdoing, despite objections from Hiestand’s family. The officers maintain that their investigation was conducted diligently and refute claims of hastiness. The report underscores the need for improved handling of sexual assault cases within the Canadian Forces.
