Minnesota officials filed a lawsuit against the Trump administration on Tuesday seeking access to evidence necessary for their independent investigation into three shootings involving federal officers in the state, including the deaths of Renée Good and Alex Pretti.
The legal action alleges that the federal government failed to fulfill its commitment to collaborate with state inquiries following an increase in federal law enforcement presence in Minneapolis earlier this year. State officials are requesting a court order compelling the Trump administration to cooperate.
Hennepin County Attorney Mary Moriarty stated, “We are ready to push for transparency and accountability that the federal government is avoiding.” This lawsuit signifies a heightened confrontation between Minnesota leaders and the Trump administration concerning the investigations into the notable shootings by federal officers that sparked public outrage and demonstrations.
The Trump administration has contended that Minnesota authorities lack jurisdiction to conduct investigations. In contrast, state officials argue that they must conduct their own investigations as they do not trust the federal government to investigate itself.
Mary Moriarty emphasized, “There must be an investigation whenever a federal agent or a state agent takes a life in our community.” The lawsuit also seeks access to evidence in a third incident involving Julio Cesar Sosa-Celis, who sustained gunshot wounds from a federal agent in January.
The ongoing fallout from the Operation Metro Surge, an immigration crackdown in Minneapolis and St. Paul, continues to impact the region. The Department of Homeland Security hailed the operation as a success, but Minnesota leaders criticized the conduct of officers and the subsequent Homeland Security shutdown.
The Department of Homeland Security noted that all shootings undergo review by an appropriate law enforcement agency, followed by an independent review internally. The Department of Justice announced a federal civil rights investigation into Alex Pretti’s killing and highlighted that a similar federal inquiry was not deemed necessary for Renée Good’s case.
The lawsuit by Minnesota asserts that the federal government cannot withhold investigative evidence to shield law enforcement officers from scrutiny during state investigations into potential criminal violations. The lawsuit challenges the federal government’s practice of categorically withholding evidence.
Rachel Moran, a law professor at the University of St. Thomas in Minneapolis, noted that such state actions against the federal government are rare. She highlighted the importance of states having the right and obligation to investigate possible crimes by officers within their jurisdiction.
