“Judge Blocks Pentagon from Blacklisting Anthropic AI”

A United States judge has issued a temporary injunction against the Pentagon’s blacklisting of Anthropic, marking a significant development in the ongoing dispute between the company and the military regarding the safety of artificial intelligence (AI) on the battlefield. Anthropic filed a lawsuit in a California federal court, claiming that U.S. Secretary of War Pete Hegseth exceeded his authority by labeling Anthropic a national security supply-chain risk without providing the company an opportunity to challenge the designation, thereby violating its rights under the First and Fifth Amendments.

U.S. District Judge Rita Lin, appointed by former President Joe Biden, sided with Anthropic in a detailed 43-page ruling. However, the injunction will not take immediate effect, allowing the administration a window to potentially appeal the decision. Hegseth’s decision to blacklist Anthropic came after the company opposed the military’s request to use its AI chatbot, Claude, for surveillance or autonomous weapons, leading to Anthropic being barred from certain military contracts. Anthropic executives expressed concerns over the significant financial losses and damage to the company’s reputation resulting from this action.

Anthropic argued that current AI models are not sufficiently reliable for use in autonomous weapons and objected to domestic surveillance as an infringement on individual rights. On the other hand, the Pentagon contended that private companies should not hinder military operations, emphasizing that they would only utilize such technology in lawful ways. Judge Lin’s ruling suggested that the government’s actions appeared to be more punitive toward Anthropic rather than being driven by genuine national security concerns.

In response to the ruling, a spokesperson for Anthropic, Danielle Cohen, expressed satisfaction with the decision while emphasizing the company’s commitment to collaborating with the government for the benefit of all Americans through safe and dependable AI technologies. This development marks the first public designation of a U.S. company as a supply-chain risk under a government procurement statute aimed at safeguarding military systems from potential foreign sabotage.

Anthropic’s legal battle extends to a separate lawsuit in Washington over another Pentagon supply-chain risk designation that could result in the company’s exclusion from civilian government contracts. The Justice Department argued that Anthropic’s refusal to comply with contractual terms could lead to uncertainties within the Pentagon on how to utilize Claude, potentially jeopardizing military systems during operations. The government maintained that the designation was not based on Anthropic’s AI safety stance but rather on its contractual stance.
